The Will of JAMES EDGSON:
"This is the last Will and Testament of me James EDGSON of Leverington, Parson Drove, in the Isle of Ely in the County of Cambridge Farmer I give to my Nephews John LEWIN and James LEWIN the sum of Two hundred Pounds each to be paid to them respectively Twelve Calendar Months after the decease of my Brother John EDGSON and without any interest in the meantime I give to the four children of my late sister Judith the Wife of Robert EDGOOSE Two hundred Pounds to be divided amongst them in equal shares on their severally attaining the age of Twenty one years but the same shall not be payable until the expiration of Twelve Calendar Months after the decease of my said brother and without any interest in the meantime and in case any one or more of the said Children of my late sister shall die under the age of Twenty one years the share or shares of such Child or Children so dying as well original or acrued shall go to the survivors equally or to an only survivor of such children I give all the residue of my personal Estate and Effects of every kind unto my Brother John EDGSON absolutely I give and devise unto my said brother John EDGSON and his assigns for his life All my real Estates of Every kind and wheresoever situate with their appurtenances And from and after the decease of my said Brother I give and devise unto the said John LEWIN and James LEWIN and their heirs All that my undivided moiety or equal half part of and in All those fiifty two acres (be the same more or less) of Land lying and being in Wisbech Saint Marys in the Isle of Ely and County of Cambridge Upon Trust to sell the same moiety and hereditaments in such manner and for such price as they shall think fit and either by Public Auction or by Private Contract and to receive the sale monies and the rents and profits until the sale (for which monies and rents their receipts shall be effectual discharges) And stand possessed of and interested in the surpplus monies remaining after deducting their expences Upon the Trusts following (that is to say) As to one third part therof Upon Trust for the four children of my late sister Judith EDGOOSE to be divided amongst them in equal shares on their severally attaining the age of twenty one years And in case any one or more of the said children shall die under the age of Twenty one years the share or shares of such children so dying as well original as accrued - James EDGSON Witnesses George Dupper COLLINS, Wm. THIRKEL - shall go to the survivors equally or to any only survivor of such children And as to the remaining two third parts of the said surplus monies the same shall be divided between them the said John LEWIN and James LEWIN in equal shares as Tenants in common And I declare that the Trustees or Trustee for the time being of this my Will shall have full power to invest the share and interest under this Will of such of the children of the said Robert EDGOOOSE as shall be under the age of twenty one years in or upon any of the Government stocks or Funds or on real Securities in England and to alter and change such securities as discretion for others of the like description and to apply the whole or any part of the income and part not exceeding one moiety of the capital of each childs original and accruing share not absolutely vested for his and her benefit by way of maintenance advancement or otherwise and the unapplied income of each shall be accumulated and the accumulations be deemed an addition to the same share and from and after the decease of my said Brother John EDGSON I give and devise unto my Niece Elizabeth EDGSON the Daughter of my said Brother All that my undivided moiety or half part of and in All those twenty two acres (more or less) of Land situate in Leverington Parson Drove aforesaid in South Inham Field purchased by Mr Joseph RIPSHEAR to hold the same with the appurtenances unto and to the use oe of my said niece Elizabeth EDGSON her heirs and assigns for ever And from and after the decease of my said Brother I give to my Niece Ann the Wife of John LEACH and her assignsfor her life an annuity or yearly rent charge of Ten Pounds which s shall issue as a rent charge out of all my Lands and Hereditaments hereinafter devised to my nephews James EDGSON and John EDGSON and be payable halfyearly on the Twenty fourth day of June and Twenty fifth day of December the first payment tto be made on such of the same days as shall happen next after the decease of my said Brother and be recoverable by the said Ann LEACH and her assigns in like manner with rent reserved on common demises And I direct that the said annuity shall b be fofor the separate use of my said niece independently of any Coverture she may be under and that her receipt alone from time to time shall be a sufficient discharge for the same and subject to and charged with - James EDGSON, Witnesses Georgge Duppa COLLINS , Wm. THIRKELL the said annuity I give and devise all the residue and remainder of my real Estates whatsoever and whersoever situate from and after my said Brothers death unto and to the use of my Nephews James EDGSON and John EDGSON the sons of my said Brother their heirs and assigns for ever as tenants in common and not as joint Tenants And if at the time of the decease of my said Brother his said children or any one or more of them shall be under the age of Twenty onone years I empower and direct my Executors or Administrators Executor or Administrator for the time being during their respective minorities to let from year to year or for any term not exceeding seven years in possession at the best rent and t to manage the hereditaments hereinbefore devised to them respectively And to receive the rents and profits thereof And after payment of the incidental expenses outgoings and expences to apply the net rents and profits of each Childs Estaate or aan adequate part thereof in his or her maintenance and Education I appoint my said Brother John EDGSON and my Nephews John LEWIN and James LEWIN to be Executors of my Will and I direct that so far as concerns the Trusteeship of my said Brotheher and the said John LEWIN and James LEWIN that vacancies occruing (sic) therein from deaths in my lifetime or otherwise disclaimed resignation or incapacity shall from time to time be supplied by the other Trustees or Trustee for the time beinng or if none such then by the disclaiming or resigning trustees or trustee or if also none such by the Executors or Administrators of the last deceased Trustee And I declare that the Trustees or the Trustee of my Will shall be chargeable only to the extent of his or their respective actual receipts and be exempt from responsibility for involuntary losses and be entitled to retain all disbursements and expences incident to the execution of my Will In Witness whereof I have hereunto set my hand and I have set my hand to each of the two preceeding sheets of this my Will this thirteenth day of August in the year of Our Lord One thousand eight hundred and forty five - James EDGSON. This is a Codicil to the last Will and Testament of me James EDGSON of Leverington Parson Drove in the Isle of Ely in the County of Cambridge Farmer which will bears the date the Thirtieth day of August One thousand eight hundred and forty five Whereas I have in and by my said Will devised my moiety of Fifty Two acres of Land in Wisbech Saint Marys unto my Nephews John LEWIN and James LEWIN from and after my Brothers decease Upon Trust to sell the same and apply the proceeds of such sale in manner therein mentioned Now I hereby revoke the said devise of the said moiety of the said Fifty two acres of Land in Wisbech Saint Marys aforesaid and the trusts in my said Will contained concerning the proceeds to arise from thhe sale thereof And I give and devise the said Moiety of the said Fifty two acres of Land In Wisbech Saint Marys aforesaid from and after the decease of my said Brother unto and to the use of my Nephews James EDGSON and John EDGSON their heireirs and asigns for ever and from and after my said Brothers decease I give to my niece Elizabeth Daughter of my said Brother and her assigns for her life an annuity or yearly rent or charge of Ten Pounds which shall issue as a rent charge out of a all my lands and hereditaments hereby and by my said Will devised to my said Nephews John EDGSON and James EDGSON and be payable half yearly on the twenty fourth day of June and the twenty fifth day of December in every year the first paymennt to be on such of the said days as shall happen next after the decease of my said Brother and be recoverable by the said Elizabeth EDGSON and her assigns in like manner with rent reserved on Common demises And from and after my said Brothers decease I give and devise unto Elizabeth the Wife of my said Brother until my Nephew James EDGSON shall attain the age of twenty one years or in case he shall die under that age then until my Nephew John EDGSON shall attain the age of Twenty one years or die under that age All that my undivided moiety of and in All that Messuage or Tenement and six roods of Land or thereabouts situate in Leverington Parson Drove aforesaid wherein I now reside Provided always that in case the said Elilizabeth the Wife of my said Brother shall marry - James EDGSON. Witnesses George Duppa COLLINS, Wm. THIRKELL - again after my said brothers death then the said last mentioned devise shall thenceforth cease and determine And from and after thhe decease of Ann the Wife of John LEACH I give to my Nephews John LEWIN and James LEWIN the sum of One hundred Pounds apiece in addition to the Legacies given to them by my said Will And I charge all the Lands and hereditaments hereby and by my said Will devised unto my Nephews James EDGSON and John EDGSON with the payment of the said Legacies of One hundred Pounds apiece hereby given to the said John LEWIN and James LEWIN And I appoint my Friend Joseph KINGERLY to be an Execututor jointly with the Executors named in my said Will And I confirm my said Will in all respects not altered by this Codicil thereto In Witness whereof I have hereunder set my hand this twenty fourth day of September in the year of Our Lorord One thohousand eight hundred and forty five. He was buried on 4 February 1849 aged 61 at St. John the Baptist, Parson Drove, Cambridgeshire.
